I haven't installed CS4 yet, but in CS3 you can not run a custom action in the same process as creating a gallery using File->Automate->Web Photo Gallery. If you already have a batch action like it sounds (but i could have misinterpreted you), that you run when creating the web gallery, you can edit that action to make it launch your logo-adding action (hit record, then launch the other action). Otherwise, you should run the action that adds the logo after you have generated the web gallery. Do this as a batch job on the generated images (tip: easily find and select the images in bridge, then launch batch or image processor from the tools->photoshop menu). Q. I have Windows Photo Gallery on my computer and I also had a bunch of pictures that I had don't want showing up on there that were in my Pictures folder.
